Coastal Fun Rentals – Terms & Conditions

Welcome to coastalfunrentals.com (the “Site”), operated by Coastal Fun Rentals (“we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the Site and our scooter and e‑bike rental services (collectively, the “Services”) on the island of Vieques.

By accessing the Site, booking online, or renting any vehicle from us, you agree to be bound by these Terms. If you do not agree, please do not use our Site or Services.

1. Eligibility

1.1 Age Requirements

You must meet our minimum age requirements to rent or operate our vehicles:
- Scooters: Minimum age: 21
- E‑bikes: Minimum age: 18
A valid government‑issued photo ID is required at the time of rental.
For scooters, a valid driver’s license may be required by law; you are responsible for meeting all legal requirements to operate any vehicle you rent.

1.2 Authority to Agree
By making a reservation or signing a rental agreement, you confirm that you are legally able to enter into this contract on your own behalf and, where applicable, on behalf of any other riders in your group.

2. Reservations, Payments & Security Deposits

2.1 Reservations

Reservations can be made via our Site, by phone, or in person, subject to availability.
A valid credit or debit card is required to secure your booking.

2.2 Pricing

All prices are listed in [insert currency] and may be subject to applicable local taxes and fees.
We reserve the right to change pricing at any time; however, once your reservation is confirmed, your quoted price will not change for that booking.

2.3 Payment

Full or partial payment may be required at the time of booking, as stated in our booking process.
Any remaining balance is due at the start of the rental period.

2.4 Security Deposit

We may require a refundable security deposit per vehicle, held on your credit card at check‑in.
The deposit may be used to cover damages, loss, late fees, cleaning fees, or violations. Any unused portion will be released in accordance with your bank’s policies.

3. Cancellations, Changes & No‑Shows

3.1 Customer Cancellations

Cancellations made 24 hours or more before the rental start time: Full Refund
Cancellations made less than 24 hours before the rental start time may be non‑refundable or subject to a cancellation fee.

3.2 Changes to Reservations

Changes are subject to availability and may result in a price adjustment.
We reserve the right to treat significant changes (e.g., date changes within 24 hours) as a cancellation and re‑booking.

3.3 No‑Shows & Late Arrivals

If you do not arrive within 60 minutes of your scheduled time and do not contact us, your reservation may be treated as a no‑show and may not be refunded.
Late arrivals do not guarantee an extension of your rental period.

3.4 Cancellations by Coastal Fun Rentals

We may cancel or reschedule rentals due to severe weather, safety concerns, maintenance issues, or other circumstances beyond our control.
In such cases, we will offer a rescheduled time or a refund/credit in accordance with our then‑current policy.

4. Check‑In, Use of Vehicles & Rider Responsibilities

4.1 Check‑In & Orientation

All renters and riders must be present at check‑in to show ID and sign the rental agreement and liability waiver.
We provide a brief orientation on vehicle operation and safety; it is your responsibility to listen, ask questions, and operate the vehicle only if you feel comfortable and capable.

4.2 Proper Use
You agree to:

Operate the vehicle safely, responsibly, and in accordance with local laws and traffic regulations.
Wear any required safety gear, including helmets which are mandatory by law.
Use the vehicle only on approved roads/paths and not off‑road, on the beach sand, or in prohibited areas, unless explicitly allowed.
Not carry more passengers than the vehicle is designed for.
Not use the vehicle under the influence of alcohol, drugs, or any impairing substance.
Not use the vehicle for racing, stunts, towing, or any unlawful purpose.

4.3 Care & Custody

You are responsible for the vehicle from the time it is checked out until it is returned and inspected.
Use the lock (if provided) when leaving the vehicle unattended.
Do not modify, alter, or attempt repairs on the vehicle. If there is an issue, contact us immediately.

5. Damage, Loss, Theft & Cleaning

5.1 Responsibility for Damage
You are financially responsible for:

Any damage to the vehicle beyond normal wear and tear.
Lost, stolen, or irreparably damaged vehicles or accessories (e.g., helmets, locks, chargers, keys).
Costs associated with recovery, towing, or retrieval of abandoned vehicles.

5.2 Accidents & Incidents

In case of an accident, injury, or damage involving third parties or property, you must:
- Ensure everyone is safe and call emergency services if needed.
- Follow local laws regarding reporting accidents.
- Notify us as soon as reasonably possible.
You agree to cooperate with us and, if applicable, insurance providers in any investigation.

5.3 Cleaning Fees

A cleaning fee may be charged if a vehicle is returned excessively dirty, with spills, or with evidence of misuse.

6. Late Returns & Early Returns

6.1 Late Returns

Vehicles must be returned by the agreed time.
Late returns may incur additional hourly or daily charges as specified in our pricing or rental agreement.
Consistent or significant lateness may result in additional fees and/or refusal of future rentals.

6.2 Early Returns

If you return a vehicle early, refunds or credits for unused time are at our sole discretion and subject to our current policy.

7. Safety, Weather & Island Conditions

7.1 Riding Conditions

You acknowledge that riding scooters and e‑bikes involves inherent risks, including traffic, road conditions, wildlife, weather, and other environmental factors specific to Vieques.
You are responsible for assessing whether it is safe to ride given your experience, the route, and conditions.

7.2 Weather

Tropical weather can change quickly. We may advise against riding during heavy rain, storms, or hazardous conditions.
We reserve the right to suspend or adjust rentals for safety reasons.

8. Assumption of Risk & Release of Liability

8.1 Assumption of Risk
By renting and operating our vehicles, you acknowledge and voluntarily assume all risks associated with their use, including the risk of personal injury, property damage, or death.

8.2 Release & Waiver
To the fullest extent permitted by law, you agree to release, indemnify, and hold harmless Coastal Fun Rentals, its owners, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses arising out of or related to:

Your use or misuse of our vehicles or Services.
Any breach of these Terms or of the rental agreement.
Any injury or damage you cause to yourself, passengers, third parties, or property.

This release does not waive any rights you may have that cannot be legally waived under applicable law.

9. Insurance

9.1 Customer Insurance

We strongly recommend that you carry adequate personal travel, medical, and liability insurance that covers scooter and e‑bike use.
To the extent permitted by law, we are not responsible for your lack of insurance coverage.

9.2 Our Coverage

Any insurance we may carry is for our benefit and may not extend to you unless expressly stated in writing.

10. Website Use & Content

10.1 Intellectual Property

All content on the Site, including text, images, logos, and design, is owned by or licensed to Coastal Fun Rentals and is protected by applicable laws.
You may not copy, distribute, modify, or use our content for commercial purposes without our prior written consent.

10.2 Accuracy of Information

We strive to keep information on the Site accurate and up to date, but we do not guarantee that all content, pricing, or availability is error‑free.
We reserve the right to correct errors and update information at any time.

11. Privacy

Your use of the Site and Services may involve providing personal information.
We handle your data in accordance with our Privacy Policy, which is incorporated by reference into these Terms. Please review it carefully before using our Site or Services.

12. Prohibited Conduct (Online & On‑Site)

You agree not to:

Use the Site or Services for any unlawful purpose.
Attempt to gain unauthorized access to our systems or data.
Submit false or misleading information when making reservations or communicating with us.
Harass, threaten, or abuse our staff or other customers.

13. Changes to These Terms

We may update or modify these Terms from time to time. The “Last updated” date at the top indicates when the latest changes were made. Continued use of the Site or Services after changes are published constitutes your acceptance of the updated Terms.

14. Governing Law & Dispute Resolution

14.1 Governing Law
